OVERVIEW
This website and mobile application are operated by Clubwell ("we," "us," "our"). Throughout the site and app, the terms "we", "us" and "our" refer to Clubwell. Clubwell offers this website (clubwell.com), mobile application (the "Clubwell App"), and all information, tools, products, and services available from these platforms (collectively, the "Services") to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By accessing our website, downloading our App, purchasing products from us, or using any of our Services, you engage in our "Service" and agree to be bound by the following Terms of Service ("Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the Services, including without limitation users who are browsers, vendors, customers, merchants, app users, community members, and contributors of content.
Please read these Terms of Service carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website, use the App, or use any Services.
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
SECTION 1 - ACCOUNT REGISTRATION & ELIGIBILITY
Age Requirements: You must be at least 16 years old to use the Clubwell App and have an account. If you are 16 or 17, we recommend you discuss using health tracking and medical devices with a parent, guardian, or trusted adult. If you are under 16, You may not create an account or use the App. During registration, you must provide your date of birth. If you indicate you are under 16, account creation will be blocked. If we discover an under-16 user, we will immediately delete the account and all data without refund. If you believe your child under 16 has created an account, email support@clubwell.com immediately.
Account Creation: To access certain features of the Clubwell App, you must create an account by providing accurate, current, and complete information including your name, email address, password, and other required information. You agree to promptly update your account information to keep it accurate, complete and current.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorised access to or use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with these security obligations.
Account Suspension or Termination: We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion, including if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.
SECTION 2 - CLUBWELL APP & DIGITAL SERVICES
App License: Subject to your compliance with these Terms, Clubwell grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Clubwell App on devices that you own or control solely for your personal, non-commercial use.
App Features: The Clubwell App provides the following features:
- Food Tab: Access to 1,000+ recipes with macro and micronutrient breakdowns, ability to create and save custom recipes
- Lifestyle Tab: Self-assessment tools for tracking sleep, movement, and stress management
- Diary Tab: Personal health journal with points-based tracking system and achievement badges
- Progress Tab: Health metrics tracking including MST Score calculation, device integration capabilities
- Club Tab: Community features, daily health content, expert discussions, educational articles, and access to the Clubwell shop
MST Score: The MST (Metabolic Sugar Tolerance) Score is a proprietary health scoring system developed by Clubwell that measures metabolic health across four key areas: waist health, blood lipids, blood sugar, and blood pressure. The MST Score is for informational and educational purposes only and should not be considered medical advice, diagnosis, or treatment. Always consult with a qualified healthcare professional before making health decisions based on your MST Score.
Device Integration: The App may connect via Bluetooth to compatible medical devices including MST monitors and biometric scales. We do not guarantee compatibility with all devices. Device manufacturers may have their own terms of service and privacy policies that govern device use.
No Medical Advice: THE CLUBWELL APP, MST SCORE, AND ALL CONTENT PROVIDED THROUGH THE SERVICES ARE FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. THEY ARE NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN THE APP OR ON OUR WEBSITE.
If you are managing diabetes, pre-diabetes, cardiovascular disease, or any other medical condition, consult your healthcare provider before using the App or making lifestyle changes based on information provided through the Services.
SECTION 3 - THECLUB: COMMUNITY FEATURES
Community Guidelines: "theClub" refers to the community and social features within the Clubwell App, including discussion groups, posts, comments, recipe sharing, and user-generated content. By participating in theClub, you agree to our community guidelines. You agree to:
- Treat all community members with respect and courtesy
- Not post content that is harmful, offensive, defamatory, harassing, threatening, hateful, discriminatory, or illegal
- Not impersonate others or misrepresent your identity or affiliation
- Not spam, advertise, or promote commercial products without authorisation
- Not share dangerous health advice or encourage unsafe practices
- Not post content that violates intellectual property rights
- Respect others' privacy and not share personal information about others without consent
User-Generated Content: When you post recipes, photos, comments, or other content to theClub, you grant Clubwell a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media. This includes the right to feature your content in marketing materials, on our website, and in the App.
You retain all ownership rights to your content, but you acknowledge that by posting publicly you allow other users to view, share, and interact with your content within the App.
You represent and warrant that:
- You own or have necessary rights to all content you post
- Your content does not violate any third-party rights
- Your content complies with these Terms and applicable laws
Content Moderation: We reserve the right, but are not obligated, to monitor, review, edit, or remove any user-generated content at our sole discretion. We may remove content that violates these Terms, is reported by users, or that we determine is inappropriate. We may also suspend or terminate accounts of users who repeatedly violate community guidelines. Please read them in full here.
Health Information Shared in theClub: Be cautious about sharing personal health information in theClub. While we implement security measures, any information you share in public forums may be viewed by other users. Do not share information you want to keep private.
Other users' posts, comments, and advice in theClub reflect their personal experiences and opinions, not medical advice from Clubwell. Do not rely on other users' health advice without consulting your healthcare provider.
SECTION 4 - PRODUCTS & SUBSCRIPTIONS
Products Available: Through our website and the Clubwell shop within the App, we sell:
- Nutritional supplements including Green5 (daily nutrition powder)
- Medical devices including blood glucose meters, blood pressure monitors, and lipid testing devices
- Biometric scales and health monitoring equipment
- Accessories including water bottles, scoops, funnels, and other wellness products
Product Information: We strive to provide accurate product descriptions, but we do not warrant that product descriptions, specifications, pricing, or other content is accurate, complete, reliable, current, or error-free. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
Subscription Services: Certain products, including Green5, are available through subscription services. By subscribing, you agree to:
- Automatic Recurring Billing: Your payment method will be automatically charged at the interval you selected (e.g., monthly) until you cancel
- First Order Starter Kit: Subscription orders may include bonus items (water bottle, scoop, funnel) with the first order only. Subsequent orders contain only the subscribed product
- Pricing: Subscription prices are subject to change with 30 days' notice. Price changes do not affect existing subscriptions until the next billing cycle
- Cancellation: You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation takes effect at the end of the current billing period
- Modification: You may skip, pause, or modify delivery frequency through your account settings
- No Refunds: Subscription payments are non-refundable except as required by law. If you cancel, you will not receive a refund for the current billing period but will not be charged again
Medical Devices: Medical devices sold through our Services are registered with the MHRA and carry appropriate CE markings. When you purchase medical devices, you acknowledge:
- You have read and understood the Instructions for Use (IFU) provided with the device before first use. You must follow all IFU instructions and warnings, and keep for reference (digital copies are also available upon request from suport@clubwell.com).
- You will use the device only as intended and in accordance with manufacturer guidelines
- Home testing results should be discussed with your healthcare provider
- We are not liable for improper use, misuse, or reliance on device results without professional medical consultation
- Devices must be calibrated and maintained according to manufacturer specifications
Medical Device Vigilance Reporting: If a medical device causes or could cause death, serious injury, or serious public health threat, you must report it to us within 10 days:

- Include: Device model, lot number, what happened.

We maintain a vigilance system as required by UK Medical Device Regulations 2002.
Blood Testing Safety: Devices requiring finger-prick blood samples may cause minor discomfort, bruising, or risk of infection. Always wash hands before testing, use a new lancet each time, and dispose in a sharps container. If you have a bleeding disorder or take blood-thinning medication, consult your doctor before use. Stop use and seek medical attention if you develop signs of infection (redness, swelling, warmth).
SECTION 5 - PRICING, PAYMENT & BILLING
Pricing: All prices are stated in British Pounds (GBP) and include VAT where applicable. We reserve the right to change prices at any time without notice. Price changes do not affect orders already placed.
Payment Methods: We accept payment via credit card, debit card, and other payment methods processed through Stripe and PayPal. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees incurred.
Payment Processing: Your payment information is processed securely by our third-party payment processors (Stripe and PayPal). We do not store complete credit card numbers on our servers. Payment processing is subject to the payment processor's terms and conditions.
Billing Information: You agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account with any changes to your email address, payment method, billing address, or shipping address.
Failed Payments: If a subscription payment fails, we will attempt to process payment again. If payment continues to fail, we may suspend or cancel your subscription. You remain responsible for any amounts due.
SECTION 6 - SHIPPING, DELIVERY & RETURNS
Shipping: We ship products to addresses within the United Kingdom. Shipping costs and estimated delivery times are displayed at checkout. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.
Delivery: Risk of loss and title for products purchased pass to you upon delivery to the shipping carrier. We are not liable for lost, stolen, or damaged packages after delivery to the carrier.
Returns & Refunds: Please see our separate Refund Policy for detailed information about returns and refunds. In summary:
- Physical products may be returned within 30 days of delivery if unopened and in original condition
- Medical devices may have different return restrictions due to hygiene and safety requirements
- Subscription payments are non-refundable except as required by law
- Digital content and services are generally non-refundable once accessed

SECTION 7 - INTELLECTUAL PROPERTY
Clubwell Intellectual Property: All content on the website and in the App, including but not limited to text, graphics, logos, images, software, data compilations, and the MST Score algorithm, is the property of Clubwell or its content suppliers and is protected by UK and international intellectual property laws.
The Clubwell name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Clubwell. You may not use these marks without our prior written permission.
Recipe Content: Recipes provided through the Services are for personal, non-commercial use only. You may not:
- Reproduce, republish, or redistribute recipes for commercial purposes
- Use recipes in your own cookbooks, websites, or publications without permission
- Remove attribution or copyright notices from recipe content
User-created recipes remain the property of the user but are licensed to Clubwell as described in Section 3.
License Restrictions: You may not:
- Modify, copy, distribute, transmit, display, reproduce, publish, license, or create derivative works from the Services
- Reverse engineer, decompile, or disassemble any aspect of the Services
- Remove any copyright, trademark, or proprietary notices
- Use the Services for any commercial purpose without authorization
- Use automated tools (bots, scrapers) to access or collect data from the Services
SECTION 8 - PRIVACY & DATA PROTECTION
Privacy Policy: Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review our Privacy Policy.
Health Data: The Clubwell App processes special category health data under UK GDPR Article 9(2)(a) with your explicit consent including:
- Metabolic markers (blood glucose, blood pressure, blood lipids)
- Body composition measurements
- Self-reported wellness metrics
- MST Score calculations
You provide consent to our collection and processing of health data as described in our Privacy Policy when you enable health tracking within the app. You can withdraw consent anytime by disabling health features or deleting your account.

Data Security: We implement appropriate technical and organizational measures to protect your personal and health data. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.
Third-Party Services: Our Services integrate with third-party services including:
- Shopify (e-commerce platform)
- Payment processors (Stripe, PayPal)
- Email marketing (Klaviyo)
- Analytics (Google Analytics)
- Device manufacturers
These third parties have their own privacy policies and data handling practices. We are not responsible for the privacy practices of third-party services.
SECTION 9 - PROHIBITED USES
In addition to other prohibitions set forth in these Terms, you are prohibited from using the Services:
- For any unlawful purpose or to solicit others to perform or participate in any unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
- To collect or track the personal information of others
- To spam, phish, pharm, pretext, spider, crawl, or scrape
- For any obscene or immoral purpose
- To interfere with or circumvent the security features of the Services
- To provide medical advice or health counselling to other users unless you are a licensed healthcare professional
- To promote unsafe health practices, eating disorders, or dangerous behaviours
- To sell, resell, or commercially exploit any portion of the Services without authorization
We reserve the right to terminate your use of the Services for violating any prohibited uses.
SECTION 10 - DISCLAIMERS & LIMITATIONS OF LIABILITY
NO WARRANTIES: THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The Services will be uninterrupted, timely, secure, or error-free
- The results obtained from use of the Services will be accurate or reliable
- Any errors in the Services will be corrected
- The Services will meet your requirements
- Any health outcomes or improvements will result from using the Services
MEDICAL DISCLAIMER: WE ARE NOT A HEALTHCARE PROVIDER. THE MST SCORE, HEALTH METRICS, AND ALL CONTENT PROVIDED THROUGH THE SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF HEALTH INFORMATION.
DEVICE ACCURACY: While medical devices sold through our Services meet applicable regulatory standards, we do not guarantee the accuracy of readings from home testing devices. Device accuracy may be affected by user error, device calibration, environmental factors, and device age. Always consult your healthcare provider about abnormal results.
LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLUBWELL, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, revenue, savings, data, use, or goodwill
- Any damages arising from your use or inability to use the Services
- Any damages resulting from unauthorized access to or alteration of your data
- Any damages resulting from reliance on health information or MST Scores
- Any damages arising from third-party content, including user-generated content
- Any damages arising from medical devices, their use, or test results
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 11 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Clubwell, our parent company, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim, demand, loss, damage, cost, or liability (including reasonable attorneys' fees) arising from or related to:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your breach of applicable laws or regulations
- Content you submit or share through the Services
- Your reliance on information from the Services
- Health decisions made based on MST Scores or other information from the Services
SECTION 12 - THIRD-PARTY LINKS & SERVICES
The Services may contain links to third-party websites, services, or resources that are not owned or controlled by Clubwell. These include:
- Links to medical research and articles
- Links to healthcare providers or services
- Links to device manufacturers
- Integration with fitness trackers and health apps
We are not responsible for and do not endorse the content, accuracy, policies, or practices of any third-party websites or services. You acknowledge and agree that Clubwell shall not be responsible or liable for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.
We encourage you to read the terms and privacy policies of any third-party websites or services you visit.
SECTION 13 - MOBILE TERMS
SMS/Text Messaging Service: By providing your mobile number and opting in, you consent to receive recurring SMS/text messages from Clubwell, including:
- Order updates and shipping notifications
- Account alerts and security notifications
- Promotional messages, offers, and reminders
- Health tips and community updates
Message Frequency: Message frequency varies based on your selections and activity. Message and data rates may apply as determined by your mobile carrier.
Opt-Out: Text STOP to any message to unsubscribe. You'll receive a confirmation message. To get help, text HELP or email support@clubwell.com.
Supported Carriers: The service is available on major UK carriers. Carriers are not liable for delayed or undelivered messages.
No Purchase Required: Consent to SMS is not required to purchase products or use the Services.
SECTION 14 - CHANGES TO SERVICES & TERMS
Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without notice. This includes:
- Adding or removing App features
- Changing the MST Score calculation methodology
- Discontinuing products
- Modifying subscription terms
- Suspending or terminating theClub or community features
We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
Terms Updates: We may update these Terms at any time by posting the updated Terms on our website and in the App. The "Last Updated" date at the top will reflect changes. Continued use of the Services after changes constitutes acceptance of the updated Terms.
For material changes, we will provide notice through:
- Email notification to your registered email address
- In-app notification
- Prominent notice on our website
You are responsible for reviewing these Terms periodically.
SECTION 15 - TERMINATION
Termination by You: You may terminate your account at any time by:
- Deleting your account through the App settings
- Contacting customer support at support@clubwell.com
- Ceasing to use the Services
Upon termination, your access to the Services will end, but these Terms shall continue to apply to your prior use of the Services.
Termination by Us: We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, if:
- You breach these Terms
- You engage in fraudulent, abusive, or illegal activity
- You violate community guidelines
- Your account has been inactive for an extended period
- We are required to do so by law
Upon termination:
- Your right to use the Services will immediately cease
- You remain liable for all amounts due up to the termination date
- We may delete your account and all associated data
- Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification provisions
SECTION 16 - GOVERNING LAW & DISPUTE RESOLUTION
Governing Law: These Terms and any disputes arising from or relating to the Services shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Jurisdiction: You agree that any legal action or proceeding relating to these Terms or the Services shall be brought exclusively in the courts of England and Wales. You consent to the jurisdiction of such courts and waive any objection to venue.
Disputes: We encourage you to contact us first if you have any concerns or disputes. Many issues can be resolved through our customer support team at support@clubwell.com.
If informal resolution is unsuccessful, you agree to resolve disputes through binding arbitration rather than in court, except where prohibited by law. Each party will bear their own costs associated with arbitration.
Consumer Rights: Nothing in these Terms affects your statutory rights as a consumer under UK law, including rights under the Consumer Rights Act 2015. For faulty goods: You can reject within 30 days for full refund, or request repair/replacement within 6 months.
SECTION 17 - GENERAL PROVISIONS
Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, and any other policies referenced herein, constitute the entire agreement between you and Clubwell regarding the Services and supersede all prior agreements, communications, and proposals.
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, pandemic, government actions, or failures of third-party service providers.
Language: These Terms are written in English. Any translations are provided for convenience only. In the event of any conflict, the English version shall prevail.
